The Nedcor study on crime found that of every 1000 crimes committed in South Africa, only 450 were reported, 230 were solved and 100 were brought to trial. Of those prosecuted, only 77 were convicted, of whom 33 were imprisoned but only eight served sentences of two years or longer. 52 What were the weak links in the negotiated settlement? The first weak link is arguably to be found in the process of negotiation itself. A striking feature of the process was the number of nonaggression pacts made between the South African government of the time and the ANC.

According to one police report, in late 1996, there were about 137 gangs in the Western Cape region, with a combined membership of between 30 000 and 50 000. About 100 of these gangs were operating in the Cape Flats. 41 Criminal gangs are, by definition, immersed in a culture of violence, and this culture does not appear to have been fundamentally affected by South Africa’s transition towards democracy. One area of conflict which almost defies classification is the communal violence experienced in the Qumbu and Tsolo regions of the Eastern Cape Province.
